Jury awards $1.5 verdict in hernia patch lawsuit

A Rhode Island jury has awarded a $1.5 million plaintiffs verdict in August 2010 in the second bellwether trial over the Kugel hernia patch. Christopher Thorpe alleged that he was injured as a result of the failure of his hernia patch implant.

In his lawsuit, Thorpe alleged that one of the two rings that holds the Kugel mesh patch in place broke, causing it to fold and become attached to his abdominal tissue. The jury in the case agreed with Thorpe’s contention that the Kugel patch was improperly designed and that its manufacturer failed to properly warn him and his doctor that the device could fail.

The Kugel hernia patch was recalled three times between December 2005 and January 2007 due to an increased risk of failure. More than 2,000 patients have filed hernia patch lawsuits alleging that they were injured because of these defects.
